Wir können es selbst noch kaum glauben: Nach zwei Jahren ist der Südtiroler Pestizidprozess endlich Geschichte! Denn am Freitag hat das Landesgericht Bozen unseren Mitarbeiter Karl Bär freigesprochen: Nachdem bereits im Januar der letzte der 1376 Kläger seinen Strafantrag zurückgezogen hatte, beantragte die Staatsanwaltschaft am Freitag eine Änderung der Anklage, durch die auch der noch im Raum stehende Vorwurf der Markenfälschung hinfällig wurde. Mit dem Freispruch ist der Versuch der Südtiroler Landesregierung und der Obstlobby, Kritik am Pestizideinsatz juristisch zu unterbinden, endgültig gescheitert. Dass Südtirol ein Pestizidproblem hat, ist eine Wahrheit, die auszusprechen uns niemand verbieten kann. Damit ist das Urteil wegweisend für Menschen in ganz Europa, die sich für eine gesunde Umwelt einsetzen und dafür juristisch angegriffen werden. Erst vor zwei Wochen hat die EU-Kommission einen Vorschlag für ein weitreichendes Gesetz gegen Einschüchterungsklagen – sogenannte SLAPPs (strategic lawsuits aganst public participation) – vorgelegt. Jetzt können wir das Urteil als weiteren wichtigen Erfolg für die Meinungs- und Informationsfreiheit in Europa feiern! Bis zu diesem Erfolg war es ein langer und mühsamer Weg, den wir nur dank der großartigen Hilfe unserer Unterstützer:innen meistern konnten. Freedom of speech won for once …
We can hardly believe it ourselves: After two years, the South Tyrolean pesticide process is finally history! Because on Friday the Bolzano regional court acquitted our employee Karl Bär: After the last of the 1376 plaintiffs had already withdrawn their criminal complaint in January, the public prosecutor’s office on Friday applied for a change in the indictment, which also made the allegation of counterfeiting, which was still pending, null and void .
With the acquittal, the attempt by the South Tyrolean state government and the fruit lobby to legally prevent criticism of the use of pesticides has finally failed. The fact that South Tyrol has a pesticide problem is a truth that no one can forbid us to speak out. The judgment is groundbreaking for people all over Europe who are committed to a healthy environment and are being legally attacked for it. Just two weeks ago, the EU Commission presented a proposal for a far-reaching law against intimidation lawsuits – so-called SLAPPs (strategic lawsuits against public participation). Now we can celebrate the judgment as another important success for freedom of expression and information in Europe!
It was a long and arduous path to this success, which we were only able to master thanks to the great help of our supporters.
